1. Introduction
These Terms of Use ("Terms") govern your use of Volero, a cycling app developed by Nader Grebe ("Valinor Labs", "we", "us"). By downloading, installing, or using Volero, you agree to be bound by these Terms. If you do not agree, please do not download or use the App.
2. The App
Volero is a cycling app that lets you record GPS rides, view route maps, analyse statistics such as distance, elevation gain, average and maximum speed, and slope, plan routes between waypoints, manage one or more bikes including specifications and photos, log maintenance entries, and optionally send your rides to Apple Health as Cycling workouts. Volero is offered as a one-time purchase: a single payment through the App Store grants you a permanent licence to use the App on your Apple devices, with no subscription, no auto-renewal, and no recurring charges.
3. One-Time Purchase
3.1 Purchase Model
Volero is sold for a one-time price through the App Store. Once you have paid for the App, you may install and use it on the Apple devices associated with your Apple ID, in accordance with Apple's Family Sharing rules and the standard Apple licensing terms.
There is no subscription, no free trial that converts to a paid plan, no auto-renewal, and no recurring billing. Volero will never charge you again after the initial purchase.
3.2 Pricing and Payment
The current price is displayed in the App Store before you purchase. The amount will be charged to your Apple ID account at the moment of purchase. Prices may vary by country or region according to Apple's pricing matrices and applicable taxes.
If we change the price for new purchases in the future, that change will not affect users who have already bought Volero — the licence you have acquired remains valid at the conditions in force at the time of purchase.
3.3 Updates and Future Versions
Bug fixes and improvements that we publish for the same App Store product remain available to you as part of your one-time purchase. If a substantially new product is released as a separate App Store app, that product is not covered by your purchase of Volero.
3.4 Refunds
Refunds for App Store purchases are handled exclusively by Apple in accordance with Apple's refund policy. Please contact Apple Support directly to request a refund. Valinor Labs cannot process refunds on Apple's behalf.
4. Apple Standard EULA
In addition to these Terms, the Apple standard End User Licence Agreement applies to your use of Volero. In the event of a conflict, whichever provision is more restrictive prevails.
5. Health, Safety and Routing Disclaimer
Volero is a tool to help you record, plan, and review your bicycle rides. It is not a medical device, a professional coaching service, a certified navigation system, nor a substitute for traffic awareness or sound judgement on the road.
Cycling carries inherent risks. By using Volero you acknowledge and agree to the following:
- You are solely responsible for your own safety, the safety of others, and compliance with all traffic laws, road regulations, and local rules that apply to your ride.
- You are solely responsible for the technical condition and roadworthiness of your bicycle, including brakes, tires, lights, and any other safety-relevant components. The maintenance reminders and recommended intervals shown in the App are general indications based on common practice, not a professional inspection. Consult a qualified bicycle mechanic for safety-critical work.
- Do not operate the App, the screen, or any planning function while cycling. Stop in a safe location before interacting with the App.
- GPS location, altitude, speed, and slope readings can be inaccurate due to weather, terrain, urban environments, signal obstruction, or device limitations. Do not rely on them as the sole source for safety-critical decisions.
- Routes calculated through Apple's MapKit framework are suggestions based on available map data. They may include roads, paths, or conditions that are unsuitable for cycling, closed, dangerous, or otherwise inappropriate. Always evaluate the route in advance, and adapt or abandon a suggested route if it does not match the real conditions on the ground.
- Background ride recording continues to use GPS while a ride is active and may consume significant battery. Plan accordingly so that your device does not run out of power during your ride.
- Wear appropriate protective gear, including a helmet, and ride within your physical limits. If you have a medical condition, are pregnant, or have any doubt about your ability to ride, consult a qualified healthcare professional before using the App for tracking sport activity.
- Cycling workouts written to Apple Health are recorded for your information only and do not constitute medical advice. Consult a qualified healthcare professional for any decisions concerning your health.
Valinor Labs cannot be held responsible for accidents, injuries, property damage, financial loss, lost time, or any other harm arising from your use of the App, your reliance on its routes, statistics, or maintenance suggestions, your decision to ride based on its information, or any inaccuracy in the underlying GPS, map, or routing data provided by Apple's frameworks.
6. License
Subject to these Terms and the Apple standard EULA, we grant you a limited, non-exclusive, non-transferable, revocable licence to use Volero for personal, non-commercial purposes on Apple devices that you own or control.
7. Acceptable Use
You agree not to:
- reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by mandatory law;
- use the App for any unlawful purpose or in a way that violates any applicable law or regulation;
- resell, sublicense, rent, or otherwise commercially redistribute the App;
- circumvent or attempt to circumvent any technical protection measure or licence enforcement mechanism of the App or of the App Store.
8. Intellectual Property
Valinor Labs owns all rights, title, and interest in and to Volero, including its source code, design, icons, illustrations, names, and any text or graphics provided by us such as default maintenance categories and pre-configured content. Your one-time purchase grants you a licence to use the App; it does not transfer ownership of any of these elements.
The content you create or import while using Volero — your rides, your bikes, your photos, your maintenance entries, your saved routes, your notes — remains entirely yours. Valinor Labs has no access to it.
9. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of GPS or map data, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or fully compatible with all Apple devices or future iOS versions, that defects will be corrected, or that the App will meet your specific requirements.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Valinor Labs is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising out of or in connection with your use of, or inability to use, the App.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, in particular liability for intent, gross negligence, or for damage to life, body or health resulting from negligence.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes to the App, our practices, or applicable law. The current version is always available at valinorlabs.de/terms-of-use-app-volero. Material changes will be communicated through the App or this page in advance where reasonably feasible. By continuing to use Volero after an update, you accept the revised Terms.
12. Termination
We may suspend or terminate your access to the App if you materially breach these Terms. You may stop using Volero at any time by deleting it from your devices. Termination does not entitle you to a refund of your one-time purchase, except where required by mandatory consumer-protection law.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.
14. Purchase and Pricing
14.1 One-Time Purchase
GymViz is offered as a one-time, non-recurring purchase through the Apple App Store. After purchase, you receive ongoing access to all included features of the App without any further charges. There are no subscriptions and no auto-renewal.
14.2 Pricing and Payment
The current purchase price is displayed in the App Store and in the App before purchase. Payment is charged to your Apple ID account at confirmation of purchase. Prices may vary by country and are subject to change for new purchases; any change will not affect users who have already completed the purchase.
14.3 Scope of the Purchase
The one-time purchase grants you the right to use the App and the features available at the time of purchase. Future features, content, or major new versions may, at our sole discretion, be included free of charge or be offered as separate paid purchases. We do not guarantee that any specific future feature will be made available free of charge.
14.4 Restore Purchases
If you reinstall the App or install it on another device signed in with the same Apple ID, you can restore your purchase at any time via the "Restore Purchases" option in the App. Purchases are tied to your Apple ID in accordance with Apple's terms.
14.5 Refunds
All purchases are processed by Apple. Refund requests are handled exclusively by Apple in accordance with Apple's refund policy. Please contact Apple Support at https://support.apple.com to request a refund.
